Judge grants Samsung's request for a look at HTC and Apple settlement agreement

A few days back Samsung asked the courts for the terms of the settlement agreement between HTC and Apple, and this evening US Judge Paul S. Grewal granted the request. Samsung is curious because they believe that some of the licenses cover those special user experience patents that Apple is quick to claim are infringed. Samsung claims that their determination of whether or not those patents were licensed will help decide if they need to stop production of devices named in prior lawsuits.

Simply put, Samsung believes that if this agreement shows that Apple is fine with another company using these patents after a payment, then that billion dollar judgment awarded to Apple ought to cover it and no further proceedings are needed.

This one isn't going away any time soon, folks.

'Doggie Doctors' Trained To Detect Ovarian Cancer In Women ...

LOS ANGELES (CBS2) ??A Southern California woman trains dogs to detect cancer in women.

Dina Zaphiris, a pet owner and dog trainer from West Hills, works with dogs four hours a day, four days a week to get them to sniff out ovarian cancer through a woman?s breath.

How does it work?

Breath samples from the women diagnosed with cancer are trapped in small tubes.

Those tubes are then mixed in with healthy samples for the dogs to find in a long tray.

Zaphiris said the system is similar to the way bomb or drug detection dogs are trained.

?(It?s) only rewarding them (when they find) the cancer. And over time, they will ignore everything healthy and only want to go toward the cancer breath,? she said.

Zaphiris said each dog has its own alert system when they find the cancer?samples.

?We have one that sits when it finds cancer, one that lies down, and one that paws,? she said.

Michael McCulloch, Zaphiris? research partner and the director of the Pine Street Foundation, said analyzing cancer through body odor has been documented for centuries.

?Experienced clinicians will tell you people who are really sick?their body odor changes, their breath odor changes,? he said. ?It was a no-brainer that if a clinician can detect these odors, that a dog can be trained to detect them, as well.?

McCulloch has published medical research on dogs detecting cancer since 2003.

He?said the ultimate goal is to figure out a non-invasive way to detect ovarian cancer before symptoms or a blood test might detect it.

Zaphiris said, ?I?ve worked with McCulloch in 2003 and the dogs were 98 to 99 percent accurate (in finding the cancer samples).?

The dog trainer said her mom, who passed away from breast cancer in 2010, was?the inspiration?of the study.

?I?m on a crusade for my mom and for myself. And for all women. If we can catch it early, we?re going to save lives,??Zaphiris said.

Zaphiris and McCulloch?s?trial is the first and only federally funded project in the country that examines exhale breath as a source of diagnostics on ovarian cancer.

Engineered bacteria can make the ultimate sacrifice

ScienceDaily (Nov. 20, 2012) ? Scientists have engineered bacteria that are capable of sacrificing themselves for the good of the bacterial population. These altruistically inclined bacteria, which are described online in the journal Molecular Systems Biology, can be used to demonstrate the conditions where programmed cell death becomes a distinct advantage for the survival of the bacterial population.

"We have used a synthetic biology approach to explicitly measure and test the adaptive advantage of programmed bacterial cell death in Escherichia coli," said Lingchong You, senior author of the study and an associate professor at the Department of Biomedical Engineering, Duke University, and the Duke Institute for Genome Sciences & Policy. "The system is tunable which means that the extent of altruistic death in the bacterial population can be increased. We are therefore able to control the extent of programmed cell death as well as test the benefits of altruistic death under different conditions." The lead author of the study is Yu Tanouchi, a graduate student in the Department of Biomedical Engineering. Anand Pai and Nicolas Buchler also contributed to the work.

Scientists have known for some time that programmed cell death can be linked to the response of bacteria to stressful conditions, for example starvation of amino acids or the presence of competitor molecules. However, it is not clear why cells should choose to die under such conditions since it gives them no immediate advantages. Some researchers have suggested that programmed cell death allows cells to provide benefits to their survivors but until now it has been difficult to test this directly in experiments.

The researchers used synthetic biology procedures to engineer Escherichia coli in such a way that the bacterial cells are capable of suicidal behavior and promoting the good of the bacterial population. To do so they introduced a gene circuit, which consists of two modules, into the bacteria. If the "suicide module" is active it leads to the rupture and death of some bacterial cells when they are challenged with the antibiotic 6-aminopenicillanic acid. If the "public good" module is expressed, a modified form of the enzyme beta-lactamase is produced, which protects surviving cells from rupture or lysis by breaking down the antibiotic. This protection only occurs when the enzyme is released from inside the bacterial cells that make the ultimate sacrifice and die after rupture.

"Our results clearly demonstrate that it is possible to have conditions where the death of some bacteria confers an advantage for the overall population of bacteria," remarked You. "The optimal death rate for the bacterial population emerges after sufficient time has passed and is clearly visible in our system."

The scientists were also able to provide a possible explanation for the "Eagle effect," an unexpected phenomenon where bacteria appear to grow better when treated with higher antibiotic concentrations. "Overall our results fill in a conceptual gap in understanding the evolutionary dynamics of programmed bacterial death during stress and have implications for designing intervention strategies for effective treatment of bacterial infections with antibiotics," concluded You.

Ex-SAC manager charged in $276 million insider scheme

NEW YORK (Reuters) - U.S. prosecutors on Tuesday charged a former SAC Capital employee with insider trading in a series of transactions that hedge fund titan Steven A. Cohen had personally signed off on.

In what they called "the most lucrative" insider-trading scheme ever, prosecutors alleged that Mathew Martoma helped Cohen's firm avoid losses and reap profits totaling $276 million in the summer of 2008 by using insider tips he got from a doctor about Elan Corp and Wyeth LLC.

Martoma is the fifth person associated with SAC Capital, one of the most widely followed and influential hedge funds, to be charged with insider trading in either a criminal or civil proceeding. He had worked for a unit of SAC Capital called CR Intrinsic Investors in Stamford, Connecticut until 2010.

The criminal complaint against Martoma, while not mentioning Cohen by name, refers to him as the "owner" of the hedge fund and makes clear that Cohen and Martoma talked often about the fund's trading in shares of Elan and Wyeth. The court papers do not indicate that Cohen had knowledge of how Martoma obtained his information.

Martoma's lawyer, Charles Stillman, said his client was an "exceptional portfolio manager" and he is confident Martoma will be exonerated.

A spokesman for SAC Capital said "Mr. Cohen and SAC are confident that they have acted appropriately and will continue to cooperate with the government's inquiry".

The charges against Martoma stem from the U.S. government's long-running investigation into improper trading in the $2 trillion hedge fund industry, which the Federal Bureau of Investigation has called, Operation Perfect Hedge.

To date, the investigation has led to more than 50 convictions with the most notable ones being former Galleon founder Raj Rajaratnam and former Goldman Sachs Group director Rajat Gupta.

Slowly, U.S. authorities have been filing charges and winning convictions against lower-level traders and analysts who once worked for Cohen, one of the hedge fund industry's most successful and best-known traders.

The latest charges come at a time when authorities are stepping up pressure on Cohen and his hedge fund. This summer, the U.S. Securities and Exchange Commission took a deposition from Cohen as part of its ongoing insider trading investigation. It is not clear what the SEC asked Cohen about.

Recently, a top deputy of Cohen's, Michael Steinberg, was named as an unindicted co-conspirator in court documents in a separate insider trading matter.

The $14 billion SAC Capital, which charges some of the highest fees in the industry, is up about 10 percent this year - double the performance of the average U.S. hedge fund.

MAJOR REVERSAL

According to court papers filed on Tuesday, Martoma spoke in July 2008 to the "hedge fund owner" and recommended selling shares of Elan and Wyeth before a negative announcement on clinical trial results for an Alzheimer's drug jointly developed by the two companies.

CR Intrinsic had initially taken long positions in Elan and Wyeth stocks before reversing itself over the course of one week, selling some stock and building up massive short positions that accounted for one fifth of all trading in Elan, federal prosecutors said.

The criminal complaint filed by federal prosecutors and a related civil lawsuit filed by the SEC contend Martoma got insider information from a doctor, Sidney Gilman, who once worked as a consultant for a so-called expert network. Hedge funds use such networks to gain insight into various industries.

Gilman, an 80-year old neurology professor at the University of Michigan, is serving as a confidential cooperating witness in the criminal case.

"Dr. Gilman is cooperating with the SEC and we expect to settle that case in short order," said Gilman's lawyer Mark Mukasey, a partner at Bracewell & Giuliani.

The name of the expert network firm does not appear in the court documents. A disclosure attached to a paper by Gilman in the medical journal Neurology lists him as a consultant for the Gerson Lehrman Group.

A spokesman for GLG declined to comment.

The court papers describe phone calls in which Gilman shared detailed information about the Alzheimer's drug's clinical trial. Gilman was chair of a committee to monitor patients' safety during the trial.

According to the criminal complaint, Gilman scheduled meetings and phone calls with Martoma that allowed him to pass on new information about the trial quickly after receiving it. He was initially positive about the drug; as a result Martoma vigorously bought shares of Elan and Wyeth.

The complaint says the hedge fund owner defended Martoma against other people inside SAC Capital who criticized the large position.

After Gilman learned the drug trial results were mostly negative, a trader for CR Intrinsic unwound its positions and made a move into options that would pay off if the stocks fell.

"By cultivating and corrupting a doctor who had access to secret drug data, portfolio manager Mathew Martoma and his hedge fund benefitted from what might be the most lucrative inside tip of all time," Manhattan U.S. Attorney Preet Bharara told reporters on Tuesday, in discussing the charges.

FIFTH FORMER SAC TRADER

The charges against Martoma are the latest in a string of insider trading allegations to be leveled against former top traders and analysts who worked at SAC Capital.

A person familiar with SAC Capital said Martoma, an alumnus of the Stanford Graduate School of Business in California, sat near Cohen at SAC Capital's large trading floor in Stamford, Connecticut.

Two former traders, Noah Freeman and Donald Longueuil, pleaded guilty to insider trading charges last year. Jon Horvath, a former analyst at a division of SAC pleaded guilty to insider trading charges in September.

Another former SAC Capital employee, Jonathan Hollander, settled civil charges of insider trading last year with the SEC.

Martoma was arrested on Tuesday morning in Boca Raton, Florida, according to a Federal Bureau of Investigation spokesman.
